Murder suspect Hayley Gilligan appeared once again in arraignment court, represented by Attorney Mark Reichel on Wednesday.
Hayley Gilligan, again tearful on Wednesday, appeared before the arraignment court for a second time and still has not entered a plea. Defense Attorney Mark Reichel indicated to Judge Sonia Cortes that there are questions about whether he will end up representing the defendant, and so they put the matter off two more weeks, to November 16.
Ms. Gilligan remains in custody on no bail facing murder charges stemming from an October 20, 2018, incident in which policing, responding to reports of a gunshot, found 35-year-old Jamie Kinseth of Davis dead from a single gunshot to the head.
Mr. Reichel told the Vanguard on Wednesday that he saw this as a self-defense case.
“She was on her way to Disneyland for five days with her mom and her sister,” he said. “We have the receipts from Disneyland.”
Mr. Reichel said, “Her story is that he came over that morning, refused to leave, refused to leave, refused to leave, she goes upstairs, gets the gun with the cellphone, goes downstairs…”
He said for about an hour they had a standoff where she told him to leave and he refused. She was threatening to call the police. He was saying, no and refusing.
“She said he rises up with something in his hand, and does it,” he said. She fired the gun, hit him once, and killed him with a single shot to the head.
Mr. Reichel reiterated, “I think it’s self-defense. I can’t imagine another circumstance in which she would pull that trigger unless she felt she had to.”
As of right now, Mr. Reichel indicated that there was no record of her calling the police on him during this incident or at any point in the past. Neither Mr. Kinseth nor Ms. Gilligan had any sort of criminal record.
Ms. Gilligan had a job, a car and an apartment.
According to Mr. Reichel, Mr. Kinseth, did “zero.” He said, “He hasn’t worked for four years.”
During the brief hearing before Judge Cortes, the Department of Justice appeared to enter a stipulation that should Ms. Gilligan be released on bail, she would have no duties as an occupational therapist. However, at this point she remains in custody on no bail.
